Terms of Service and End User License Agreement

1. Who you are contracting with
terce is operated by Bohdan Kolesnik, an individual entrepreneur registered in Ukraine, of Vinnytsia, vul. Skaletskoho 36A, apt. 21, Ukraine. In these terms, "we", "us" and "our" mean Bohdan Kolesnik, and "you" means the person using terce.

Purchases made on this website are sold by Paddle.com Market Ltd, not by us. Paddle is our authorised reseller and the merchant of record for every web purchase: Paddle takes your payment, issues your invoice, handles tax, and appears on your bank statement. Paddle's own Buyer Terms apply to that transaction alongside these terms. Purchases made inside the iOS app are sold by Apple under Apple's terms.
2. What terce is
terce is an iOS app that runs work and break intervals as a fullscreen clock, and keeps a record of the time you have focused. It is a timer and a record. It does not block apps, silence notifications, restrict your device, or supervise how you spend your time.
An interval runs on the wall clock. Once you start one, it keeps time whether the app is open or not — you can lock the phone, put it in a pocket, or take a call, and the interval finishes on its own. An interval either finishes or you stop it.
terce is not a medical device and is not a treatment for any condition. Nothing in the app or on this site is medical advice.
3. Your licence
We grant you a personal, non-exclusive, non-transferable licence to install and use terce on Apple devices you own or control, for as long as your subscription or purchase entitles you to.
You may not copy, sell, sublicense or rent the app; reverse-engineer, decompile or disassemble it except where that restriction is prohibited by law; remove any proprietary notices; or use it in any way that breaks the law.
We keep all rights we do not expressly grant you. The app, its name, its clock faces, its design and its code remain ours.
4. Buying terce
We sell three things:
- a monthly subscription, which renews every month until you cancel;
- an annual subscription, which renews every year until you cancel;
- a lifetime purchase, which is a one-time payment and does not renew.
Prices are shown at checkout, in your own currency where we can offer it. The price you see at checkout is the price you pay. terce is not on sale yet, so no plan can be bought today — this section describes the plans as they will be offered, and takes effect when they are.
5. Subscriptions renew automatically
Both subscription plans renew automatically at the then-current price until you cancel. We will charge the payment method on file at the start of each new billing period. Where a plan includes a free trial, we will charge you when the trial ends unless you cancel before then.
Where the law requires it, and in every case where a price changes, we will email you before the renewal is charged.
6. Cancelling
You can cancel at any time, and cancelling takes effect at the end of the period you have already paid for — you keep access until then.
- Bought on this website: use the link in your Paddle receipt email, or email us at terceapp.support@gmail.com and we will cancel it for you.
- Bought inside the app: cancel in Settings on your iPhone, under your Apple Account → Subscriptions. We cannot cancel an Apple subscription on your behalf; only Apple can.
7. Refunds
Our refund policy is set out in full at /refunds and forms part of these terms.
8. Accounts and access
terce has no account and no password. If you buy on this website, we send you a claim link that binds your purchase to the app on first launch. Keep that link — anyone who has it can claim the purchase. If you lose it, email us and we will re-issue it.
If you buy inside the app, your purchase is tied to your Apple Account and restores with Restore Purchases.
9. Acceptable use
Do not use terce to do anything unlawful, to interfere with the service or with anyone else's use of it, or to attempt to gain access to systems or data you have no right to. We may suspend access if you do, and we will tell you why.
10. Changes to the app and to these terms
We will keep developing terce, and features may be added, changed or removed. If we make a change to these terms that materially affects you, we will give you notice before it takes effect — by email where we have your address, and on this page in every case. Continuing to use terce after that means you accept the new terms. If you do not accept them, cancel, and we will refund the unused part of any period you have paid for.
11. Availability
We aim to keep terce working, but we do not promise it will be uninterrupted or error-free. The app runs on your device and keeps time locally, so it continues to work if our website or our services are unavailable.
12. Disclaimers and limits
To the extent the law allows, terce is provided as is and we exclude all implied warranties.
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you for any claim connected with terce is limited to the amount you paid us in the twelve months before the claim arose.
Your statutory rights as a consumer are not affected by anything in this section. If you are a consumer in the EU or the UK, you keep every right your local law gives you, including your rights around faulty digital content, regardless of what these terms say.
13. Apple
The following applies to the app when you obtain it through the App Store:
- This agreement is between you and us, not with Apple. Apple is not responsible for terce or its content.
- Apple has no obligation to provide any support or maintenance for terce.
- If terce fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind.
- We, not Apple, are responsible for any claim that terce or your use of it infringes a third party's intellectual property rights, and for addressing any consumer claims relating to terce.
- You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance Apple will have the right to enforce it against you.
14. Governing law
These terms are governed by the laws of Ukraine, and the courts of Ukraine have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring a claim in your local courts.
