Terms of Service and End User License Agreement

1. Who you are contracting with

terce is operated by Bohdan Kolesnik, an individual entrepreneur registered in Ukraine, of Vinnytsia, vul. Skaletskoho 36A, apt. 21, Ukraine. In these terms, "we", "us" and "our" mean Bohdan Kolesnik, and "you" means the person using terce.

terce is sold only inside the iOS app, through Apple's App Store. Apple takes your payment, issues your receipt and handles tax, under Apple's own terms, which apply to that purchase alongside these terms. We do not sell anything on this website.

2. What terce is

terce is an iOS app that runs work and break intervals as a fullscreen clock, and keeps a record of the time you have focused. It is a timer and a record. It does not block apps, silence notifications, restrict your device, or supervise how you spend your time.

An interval runs on the wall clock. Once you start one, it keeps time whether the app is open or not — you can lock the phone, put it in a pocket, or take a call, and the interval finishes on its own. An interval either finishes or you stop it.

terce is not a medical device and is not a treatment for any condition. Nothing in the app or on this site is medical advice.

3. Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use terce on Apple devices you own or control: what the app offers free of charge, for as long as we offer it free, and what a subscription adds, for as long as your subscription entitles you to.

You may not copy, sell, sublicense or rent the app; reverse-engineer, decompile or disassemble it except where that restriction is prohibited by law; remove any proprietary notices; or use it in any way that breaks the law.

We keep all rights we do not expressly grant you. The app, its name, its clock faces, its design and its code remain ours. The open-source libraries inside it remain under their own licences, listed in the Acknowledgements.

4. Buying terce

terce is free to download and use: the timer, Siri and the Live Activity, four of its clock faces, and today's total. A subscription adds the other four clock faces, the full record of your past days, and the share card. The screen where you subscribe says what a subscription adds before you pay.

We sell two subscriptions:

• a monthly subscription, which renews every month until you cancel;
• an annual subscription, which renews every year until you cancel.

Both are sold only inside the app, through the App Store. There is no one-time or lifetime purchase on sale. If one is ever offered, these terms will describe it before it goes on sale.

Prices are shown in the app before you buy, in your own currency. The price you see there is the price you pay. terce is not on the App Store yet, so nothing can be bought today — this section and §5 describe the plans as they will be offered, and take effect when they are.

5. Subscriptions renew automatically

Both subscription plans renew automatically at the then-current price until you cancel. Apple charges the payment method on your Apple Account at the start of each new billing period, unless you cancel at least 24 hours before it begins.

A plan may start with a free trial, and the trial turns into the subscription unless you cancel. The screen where you start it says whether there is one and how long it lasts. You start it in Apple's purchase sheet, with your Apple Account. Nothing is charged during the trial. When it ends, the plan you chose begins and renews automatically at the price shown, unless you cancel at least 24 hours before the trial ends, in Settings on your iPhone under your Apple Account → Subscriptions. We tell you the date and the amount before anything is charged: on the screen where you start the trial, and again once it has started. Apple offers one free trial per Apple Account, so if you have had one, the plan is charged when you subscribe, and the screen says so before you do.

If the price of your subscription changes, Apple tells you before the renewal is charged, under its own terms. Apple holds your contact details, not us, so the notice comes from Apple.

6. Cancelling

You can cancel at any time, in Settings on your iPhone under your Apple Account → Subscriptions. Cancel at least 24 hours before your subscription renews to stop that renewal. Cancelling takes effect at the end of the period you have already paid for: you keep what the subscription adds until then, and the free part of terce keeps working after it.

We cannot cancel an App Store subscription on your behalf; only Apple can.

7. Refunds

Apple, not us, decides refunds for App Store purchases. Request one at reportaproblem.apple.com. Our refund policy at /refunds says more, and forms part of these terms.

8. Accounts and access

terce is not on the App Store yet, so nothing can be bought today.

terce does not ask you to sign in, or for your email address. There is no account to create. Your subscription belongs to your Apple Account: on a new iPhone, or after reinstalling terce, tap Restore on the paywall to bring it back.

If you signed in to an account on an earlier version of the app, Settings → Account still shows it, and you can sign out there or delete the account. Deleting it removes your email address from terce; we email a code to that address first, to confirm it is you. You can also ask us by email to delete it. Deleting an account does not cancel a subscription — cancel that as §6 describes.

9. Acceptable use

Do not use terce to do anything unlawful, to interfere with the service or with anyone else's use of it, or to attempt to gain access to systems or data you have no right to. We may suspend access if you do, and we will tell you why.

10. Changes to the app and to these terms

We will keep developing terce, and features may be added, changed or removed. If we make a change to these terms that materially affects you, we will give you notice before it takes effect — by email where we have your address, and on this page in every case. Continuing to use terce after that means you accept the new terms. If you do not accept them, stop using terce and cancel your subscription as §6 describes; you can ask Apple to refund the part of a period you have paid for and not used (§7).

11. Availability

We aim to keep terce working, but we do not promise it will be uninterrupted or error-free. The app runs on your device and keeps time locally, so it continues to work if our website or our services are unavailable.

12. Disclaimers and limits

To the extent the law allows, terce is provided as is and we exclude all implied warranties.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you for any claim connected with terce is limited to the greater of the amount you paid for terce in the twelve months before the claim arose, including what you paid Apple for it, and 50 US dollars.

Your statutory rights as a consumer are not affected by anything in this section. If you are a consumer in the EU or the UK, you keep every right your local law gives you, including your rights around faulty digital content, regardless of what these terms say.

13. Apple

terce is obtained through the App Store, and the following applies to it:

• This agreement is between you and us, not with Apple. Apple is not responsible for terce or its content.
• Your licence in §3 lets you use terce on Apple devices you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions permit, except that other accounts in your Family Sharing group may also use it where Apple allows.
• Apple has no obligation to provide any support or maintenance for terce. We provide it, at the address in §15.
• If terce fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind.
• We, not Apple, are responsible for addressing any claim you or anyone else makes about terce or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
• We, not Apple, are responsible for investigating, defending, settling and discharging any claim that terce or your use of it infringes a third party's intellectual property rights.
• You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• When you use terce, you must comply with the terms of any third party whose service you use with it, such as your mobile network.
• Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance Apple will have the right to enforce it against you.

14. Governing law

These terms are governed by the laws of Ukraine, and the courts of Ukraine have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring a claim in your local courts.
